WEBSITE DESIGN OPERATING AGREEMENT

This Website Design Operating Agreement is entered into by and between:

Far Beyond Creations (“FBC”),
and

Client Name: ________________________________ (“Client”)

Together referred to as the “Parties.”

1. PROJECT OVERVIEW

This Agreement governs the website design and/or digital services to be provided by FBC to Client.

2. DEPOSIT & PAYMENT TERMS

The Client agrees to the following payment schedule:

  • Deposit – 50%
    A deposit equal to fifty percent (50%) of the total project cost is required before any work begins.
  • Second Payment – 30%
    The 2nd payment is collected once the main website layout is complete, including but not limited to:

     

    • Header, navigation, and footer
    • Main body content
    • Contact forms
    • Social media integration
  • Final Payment – 20%
    Once the final payment is collected:

     

    • The website is deployed and hosted
    • All files are transferred
    • Login credentials and access details are provided to Client

3. NON-REFUNDABLE DEPOSIT

Client understands and agrees that the initial 50% deposit is non-refundable.

This deposit is paid to FBC for time already spent on:

  •  Conversations and consultation with Client
  • Researching and reviewing of Client’s product or service
  • Time spent estimating scope, structure, and timeline
  • Time reserved on FBC’s schedule for the Client’s project
  • Design work that has already commenced 

Client acknowledges that time, research, and effort has already been invested prior to the delivery of visible materials. As such, the 50% deposit is earned upon receipt and is not refundable for any reason once collected by FBC. The deposit is not refundable for any reason, including changes in client’s business, economic changes or any other reasons whatsoever.

4. DESIGN DIRECTION & REVISIONS

This website project includes up to ____________ hours of meeting, revision, and consultation time at no additional cost.

This time includes:

  • Phone calls
  • Emails
  • Text messages
  • In-person meetings

All revision and consultation time is accounted for in 15-minute increments.

Once a basic website design and visual direction are approved, FBC will proceed using the agreed-upon layout, structure, and creative direction to ensure project efficiency and timely completion.

5. ADDITIONAL TIME & BILLING

Once the included ____________ hours are exceeded, additional time is billed at a rate of $75 per hour, calculated in 15-minute increments.

Additional billing applies only to work related to an active project and allows Designer to maintain fair scheduling, focused attention, and high-quality output for all clients.

6. CLIENT RESPONSIBILITIES

Client agrees to:

  • Provide user names and passwords for social media and all other necessary platforms
  • Supply required content promptly, including written copy, logos, photos, and graphics
  • Give feedback when asked to avoid conflicting direction

7. PROJECT PAUSE OR TERMINATION

If Client pauses, cancels, or terminates the project after work has begun:

  • All payments made up to that point are non-refundable
  • Work completed up to that point remains billable

Upon receipt of any outstanding balance, FBC will release all existing website files to Client.

8. GENERAL TERMS

This Agreement represents the entire understanding between the Parties and supersedes any prior discussions or agreements. Any changes to this agreement must be made in writing and agreed upon by both Parties.
